Terms of Service
1. Acceptance of Terms
By creating an account, or by accessing or using the Novum platform in any way, you agree to be bound by these Terms of Service — creating an account and using the platform signifies your acceptance. If you do not agree, you must not create an account and must discontinue use of the platform.
2. Nature of Service
Novum is a management platform providing digital tools, distribution services, promotional resources, analytics, AI assessments, brand strategy, creator development tools, and educational programs. Novum is not a record label and does not act as a legal representative.
3. Payments and Refunds
All payments made to Novum are final. No refunds will be issued for cancellations, unused time, account termination, or dissatisfaction with services. Artist School 101 fees and Novum AI pass fees are non-refundable.
4. User Responsibilities
Users must provide accurate information when creating accounts or submitting materials. Users are responsible for ensuring they have rights to all uploaded content. Users must comply with all third-party platform rules, including but not limited to Spotify, Apple Music, YouTube, TikTok, and Instagram.
5. Distribution
Underground and Independent plans receive standard distribution. Pro and Partner plans receive priority distribution. Novum is not responsible for delays, errors, or issues caused by third-party platforms.
6. Royalties & Percentage
For artists, Novum pays out 100% of the royalties it receives from its third-party distribution and operations methods (stores, DSPs and partners) — Novum does not take a cut of your royalties on any plan. This also means that if Novum receives nothing from those third parties, there is nothing to pay out, and by agreeing to these Terms you acknowledge and accept this. Payout timing depends on when third-party platforms report and pay. Royalties for a release unlock once that individual release passes 2,000 streams.
7. Novum AI (November)
Novum AI, known as November, is Novum's own in-house assistant, available inside Artist, Brand, Creator and Partner plans and as a standalone Novum AI pass ($2/mo) or Novum AI Pro pass ($4/mo). November generates content on request and CAN produce mature, explicit, uncensored language and lyrics (for example drill, crashout or R&B themes) as a creative tool. Generated content is fictional creative output, does not represent Novum's views, and must not be treated as advice (legal, financial, medical or otherwise). Users are solely responsible for how they use any output. The only content November will never generate is racial slurs or hate speech.
8. Copyright and Content Ownership
Users must own or have proper licensing for all content uploaded to Novum. Novum is not liable for copyright disputes, takedowns, or legal claims arising from user content or from content generated with Novum AI.
9. Prohibited Actions
Users may not: upload copyrighted material without rights; leak unreleased content; harass staff or other users; attempt to hack or bypass systems; misuse AI tools; or use Novum AI to produce hateful or illegal content. Violations may result in immediate termination without refund.
10. Limitation of Liability
Novum is not liable for: lost opportunities, failed releases, sponsor decisions, brand performance, external platform outages, corrupted files, user errors, financial losses, or any outcome, decision, or content produced by or acted upon from Novum AI. You use the platform and Novum AI at your own risk.
11. Age Requirement & Parental Responsibility
Novum and Novum AI are intended for users aged 15 and older; users aged 13–14 may use the platform ONLY with the active guidance and consent of a parent or legal guardian. We do not knowingly permit anyone under 13 to use Novum. Because Novum AI can produce mature content, a parent or guardian is fully responsible for supervising any minor's use. Novum assumes NO liability for underage use, for any content a minor accesses or generates, or for a user misrepresenting their age. If we learn an account belongs to someone under 13, or to a minor without guardian consent, we may terminate it.
12. Account Termination
Novum may terminate accounts for violations of these terms, suspicious activity, fraud, harassment, or misuse of tools.
13. Modifications
Novum may update services, pricing, or terms at any time. Continued use of the platform constitutes acceptance of updated terms.
14. Governing Law
These terms are governed by the laws of the United States and the State of Delaware.
